Welcome to Sociafy. These Terms of Service (“Terms”) govern your access to and use of our website, dashboard, AI tools, mobile features, and all related services (“Service”). By accessing or using Sociafy, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use of the Service immediately.

These Terms apply to all users — including creators, agencies, businesses, team members, and visitors. Please read them carefully as they outline your rights, responsibilities, restrictions, and limitations when using Sociafy.

1. Eligibility & Use of Service

You must be at least 18 years old to use Sociafy. By creating an account, you confirm that:

• You are legally capable of entering into a binding contract.
• Your information is accurate, complete, and up to date.
• You will maintain the confidentiality of your login credentials.

You are responsible for all activities that occur under your account. Sociafy is not responsible for unauthorized access resulting from your actions or negligence.

2. Acceptable Use Policy

When using Sociafy, you agree NOT to:

• Violate any third-party terms, including Instagram, Facebook, Twitter/X, TikTok, YouTube, or LinkedIn policies.
• Publish or distribute spam, illegal content, hate speech, or sexual/violent material.
• Use the Service to automate fake engagement such as bots, fake likes, fake comments, or purchased followers.
• Upload or generate copyrighted content without permission.
• Harass, impersonate, or threaten individuals or organizations.
• Use the Service to distribute malware, harmful scripts, or unauthorized advertisements.
• Reverse engineer, modify, decompile, or attempt to extract source code from Sociafy or its systems.

Violation of this policy can result in immediate termination of your account without refund.

3. Account Suspension & Termination

Sociafy reserves the right to suspend, restrict, or permanently terminate your account if:

• You violate these Terms.
• You misuse automation tools or breach platform rate limits.
• You engage in fraudulent, harmful, or illegal activity.
• Your payment fails or subscription misuse is detected.

No refunds will be issued for accounts terminated due to prohibited activities or policy violations.

4. Payments, Billing & Refunds

Sociafy subscription payments are handled securely through trusted payment providers such as Stripe and Razorpay.

• Subscriptions will auto-renew unless canceled before the billing date.
• You can cancel anytime through your dashboard settings.
• We offer a 14-day money-back guarantee for first-time customers.
• After the 14-day period, all payments are final and non-refundable.
• If a payment is declined or reversed, your account may be paused until resolved.

In rare cases, Sociafy may offer prorated refunds at its discretion, but is not obligated to do so.

5. No Guarantee of Performance or Results

Sociafy is a tool designed to assist with content creation, analytics, and automation. However, we do not guarantee:

• Increase in followers, likes, comments, or engagement.
• Growth in revenue or sales.
• Viral performance of any content.
• Consistency in social media algorithm behavior.

Social platforms update policies and algorithms frequently. Your results will vary depending on content quality, niche, competition, audience behavior, and other external factors.

6. Limitation of Liability

To the fullest extent permitted under applicable law, Sociafy is not liable for:

• Indirect, incidental, or consequential damages.
• Loss of revenue, data, business, or opportunities.
• Account bans, suspensions, or restrictions on platforms.
• AI-generated content that violates policies or laws.
• Outages, bugs, technical issues, or API failures.

You use Sociafy entirely at your own risk. We provide tools, but you are responsible for how you use them.

7. Intellectual Property Rights

You retain full ownership of the content you upload or publish via Sociafy. For AI-generated content (captions, hashtags, images), you receive a worldwide, non-exclusive license to use, modify, publish, or distribute.

Sociafy owns all rights to the platform, UI/UX design, codebase, branding, and proprietary AI systems. Unauthorized copying or reproduction is strictly prohibited.

8. Service Availability & Updates

While we aim for 99.9% uptime, the Service may become temporarily unavailable due to:

• API changes by social platforms
• Scheduled maintenance or upgrades
• Server issues or outages
• Unexpected system failures

Sociafy may update or discontinue features without prior notice. We are not liable for losses arising from downtime or feature changes.

9. Termination by User

You may cancel your subscription at any time. You will continue to have access to the Service until the end of the current billing cycle. Export or download your data before canceling — Sociafy may delete data after account closure.

10. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be resolved exclusively in the courts located in Delhi, India.
